Terms and Conditions of Service

1. Provider and scope

These Terms govern plottybot.com and the PlottyBot services provided by Surf Publishing S.r.l., Via Rignano 17/B, 52011 Bibbiena (AR), Italy, VAT No. 02485200519 (“Surf Publishing”). By creating an account or placing an order, the user enters into a contract with Surf Publishing and accepts the version of the Terms presented at that time.

The service is for adults and persons able to enter into the contract. Mandatory consumer rights always remain applicable.

2. Accounts

Users must provide accurate information, keep credentials confidential and promptly report unauthorised access. Each account is personal. Surf Publishing may carry out reasonable checks, suspend unusual activity and request verification necessary for security, fraud prevention or order fulfilment.

3. What PlottyBot provides

PlottyBot uses artificial intelligence systems to turn user instructions, text and materials into a book. Depending on the selected flow, the service may include a creative wizard, title and cover, writing, formatting, online reader, editor, DOCX/PDF downloads and printing.

The features and price shown in the order summary and checkout prevail over general descriptions elsewhere on the Site.

4. Express flow and drafts

In the Express flow, the user defines the book through the wizard, approves its title and cover, and completes any required payment. Writing may start immediately after activation and may be processed in a queue. When the book is ready, the user confirms the included copy and may purchase additional copies before it is sent to print.

The system may allow up to three pending Express books. Drafts are kept until the date shown in the interface; in the current Express wizard the standard period is seven days from the latest activity. They may be deleted automatically after expiry. Covers may be regenerated within the limits displayed in the flow.

When the book is ready, the user may read, edit where available and download it. Before printing, the user must review the content and confirm using “Print and ship” or an equivalent command. After confirmation, the files enter prepress and production; later changes are not guaranteed and may not appear in the printed copy.

5. Print specifications and delivery

Unless checkout states otherwise, new Express books use a paperback binding, colour interior and white paper. The ordinary trim size is 6×9 inches for fiction, novels and biographies and 7×10 inches for other categories. Minimum page counts and minor technical adaptations may depend on the printer’s requirements.

Printing and delivery may be performed by specialist providers, including Lulu. Users must provide a complete and accurate address. Any estimate, including 7–10 days after printing begins, is indicative and may vary due to production, destination, carrier, customs or external causes. Risk passes in accordance with applicable law upon delivery.

6. Prices, payments and quantities

The total price, currency, quantity, applicable taxes, promotions and charges are shown before ordering. Currency conversions are calculated by the system and may vary. Payments are handled through WooCommerce and payment providers such as Stripe; Surf Publishing does not receive full card details.

The selected quantity determines the number of copies. Volume discounts or decreasing prices apply only when displayed at checkout. Coupons and promotions may have specific terms and expiry dates.

A book purchased before personalisation remains available in the user’s account until the relevant Express flow is started and is not redeemable for cash. Unless the offer states otherwise, the purchase includes one book and one copy; additional services and copies are purchased separately. Refunds, reversals or chargebacks may make a purchased but unstarted book unavailable.

7. User obligations regarding content

Users remain responsible for their instructions, text, images and other uploaded materials, as well as for use and publication of the result. They must not provide unlawful, defamatory, fraudulent, discriminatory or unlawful pornographic content, or material that infringes privacy, copyright, trademarks, image rights or other third-party rights.

If a book concerns real persons, including minors, the user must have a suitable legal basis and any necessary permissions. Highly sensitive data or confidential documents should not be entered unless strictly necessary and lawfully usable. To the extent permitted by law, users shall indemnify Surf Publishing against third-party claims arising from unlawful materials or instructions attributable to them.

8. Nature of AI output

AI output is probabilistic and may contain errors, repetition, inconsistencies, invented elements or unintended similarities. PlottyBot does not replace professional advice and does not warrant factual accuracy, absolute originality, commercial suitability or a particular editorial outcome.

Users must carefully review text, images, formulas, names, quotations and layout before publication or print confirmation. Surf Publishing may apply technical checks and moderation but does not undertake a general obligation to review every item in advance.

9. Rights in content

Users retain rights in the materials they provide. As between the parties, Surf Publishing does not claim ownership of the generated book. Users may use the output to the extent permitted by law, bearing in mind that copyright protection and exclusivity of AI-generated content may vary by jurisdiction and by the level of human contribution.

Users grant Surf Publishing a non-exclusive, limited and royalty-free licence to process, store, convert and transmit materials only as needed to provide, secure and support the service, produce and deliver copies and comply with law. No public promotional use of a user’s book is authorised without an additional legal basis.

10. Reader, editor, downloads and retention

The reader and editor are ancillary tools and may render content differently from DOCX, PDF or print. Users must review the final print-ready PDF. Completed books remain available for the period shown in the account: currently, as a general rule, three months for Express and twelve months for Pro. At expiry, files, images and book data may be deleted automatically and may no longer be recoverable.

Users should therefore download and retain their files promptly. Information required for orders, payments, printing, support or legal obligations may be retained separately as described in the Privacy Policy.

11. Withdrawal, cancellations, defects and refunds

Mandatory consumer rights remain unaffected. The right of withdrawal may be excluded or cease in the circumstances provided by law, particularly for clearly personalised goods, digital content whose performance has begun with the required consent and fully performed services under the applicable conditions.

Because each book is created to the user’s instructions, cancellation may no longer be possible once personalisation or production has begun. Before that point, users should contact support promptly; Surf Publishing will assess the actual processing stage and applicable rights. Purchased but unstarted books follow statutory rules and the conditions displayed at purchase.

Creative preferences or subjective dissatisfaction do not in themselves constitute a technical defect. For non-delivery, unusable files, damaged copies, print errors or other non-conformity attributable to the service, users should contact info@plottybot.com with the order number and useful evidence. Surf Publishing will provide the remedy required by law and appropriate to the case, which may include reprocessing, reprinting, price reduction or refund where due.

12. Availability and technical changes

Surf Publishing may update models, suppliers, interfaces and procedures while preserving the essential function of the purchased service. Maintenance, supplier limits, temporary outages or force majeure may delay processing. In the event of a serious error, the service may retry automatically or require human intervention.

13. Suspension and termination

Surf Publishing may suspend or close an account for serious or repeated breaches, fraud, security risk, abusive chargebacks or legal obligations. Where reasonably possible, users will be informed and allowed to retrieve content still available, except in urgent cases, where prohibited by law or where third-party rights are at risk.

14. Liability

To the extent permitted by law, Surf Publishing is not liable for indirect loss, lost opportunities or consequences arising from content selected or published by the user, inaccurate data supplied by the user, use contrary to these Terms or third-party services outside its reasonable control.

Nothing excludes liability that cannot lawfully be excluded, including liability for wilful misconduct or gross negligence, or limits mandatory consumer guarantees and remedies.

15. Privacy and communications

Personal data processing is described in the Privacy Policy. Communications necessary for the account, writing, payment, printing and security form part of the service. Promotional communications rely on the applicable legal basis and can be stopped using the method in the message or by contacting Surf Publishing.

16. Changes to these Terms

Surf Publishing may update these Terms for legal, technical or organisational reasons. Material changes affecting previously purchased services will be notified with reasonable notice where required. Orders already concluded remain subject to the conditions applicable at purchase, except for changes required by law or accepted by the user.

17. Law, disputes and contact

These Terms are governed by Italian law. For consumers, jurisdiction lies with the court determined by mandatory rules, including the court of residence or domicile where applicable; in other cases, the Court of Arezzo shall have jurisdiction. Consumers may also contact the competent alternative dispute resolution bodies. The former EU ODR platform was discontinued on 20 July 2025.
